Pérez Art Museum Miami (“PAMM”)(collectively “PAMM”, “us” or “we”) is committed to protecting the privacy and personally identifiable information (“Personal Information”) it receives from its visitors and donors.

This Privacy Policy governs to the way PAMM collects, uses and discloses information both online and offline, including through any website and their subdomains, including websites accessed through users mobile devices or downloadable mobile applications (“Websites”), application, feature, widget, PAMMTV™, other online service, or through your use of Wi-Fi networks provided networks provided by PAMM (“Site”), including information collected from donors. This Privacy Policy describes our information collection practices, such as the types of information we collect regarding visitors to the Site (including donors) and how we may use or disclose that information. By using any PAMM Website or donating to PAMM, you consent to this Privacy Policy.

This Privacy Policy is incorporated into our Website Terms which, together with this Privacy Policy, govern your use of the Site. We want to make this Privacy Policy as clear as possible. PAMM is located in the United States and our communications are intended only for individuals located within the United States. If you choose to access our website or sign up for our communications or provide your Personal Information otherwise from outside of the United States, some jurisdictions may provide for additional privacy rights and disclosures to their residents or relevant data subjects that may apply to you in certain circumstances. Please see the “Special Notice for International Users” and “State Specific Rights” section below for relevant information for users outside of the United States. 2. Definitions

“Communications” or “to communicate” means when you communicate with us in any way including by calling or emailing use, connecting with us on social media, posting to our social media pages, tagging us in your social media posts, creating an on-line customer account, responding to or participating in any surveys, contests or promotions or when you sign up for any newsletters, or contacting us in any other way or form.

“Location Data” is a category of Personal Information collected about your location or a location of a mobile device or computer, including GPS location or IP address (for audit and security purposes).

“PAMM,” “us,” or “we” means Pérez Art Museum Miami,

“Personal Information” means information that is linked to a specific, identifiable individual (which may include without limitation first and last names, home addresses, e-mail addresses, phone numbers, demographic information and age).

“Payment Information” bank account information, debit card number, credit card number, gift card information or any other financial information.

“Website” or “Site” means this website, its subdomains and any other website owned or operated by us.

“Usage Data” information we and our third-party service providers (including any third-party content, advertising, and analytics providers) may collect and use using a variety of technologies that automatically or passively collect certain information about your use of the Website whenever you visit or interact with the Website.

“You” or “Your” means visitors of users of the Website.

3. What Types of Information Does PAMM Collect

PAMM only collects your Personal Information when we have a legitimate legally authorized reason for doing so, such as to fulfill online orders, to facilitate customer services and inform you of PAMM events and offers. We only collect Personal Information that is reasonably necessary to provide our Site to you, to facilitate our services and for the purposes set forth in this Policy. The information we collect can come from information you provide, information we collect through automated means, and information we collect from other sources.

3.1. Information You Provide

PAMM may gather personal information, which is information that is linked to a specific, identifiable individual (such as, but not limited to, first and last names, home addresses, e-mail addresses, phone numbers, user name, and/or password) (“Personal Information”). If the Site offers an account or personal profile, we may require that you supply us with Personal Information to set up such an account, which you can review, change or sign out of any time. When you donate or make a membership, product, or ticket purchase with PAMM online or onsite, we may collect information needed to process and acknowledge, which may include your name, address, telephone number, email address, and Payment Information for that purchase. And, we may collect other information about you, such as demographic information (e.g., your age or gender), and information about your preferences and interests. If we combine demographic or other non-Personal Information with Personal Information, we will treat the combined information as Personal Information under this Privacy Policy. 3.2. Information We Collect Automatically as You Access and Use the Site

We and our third-party service providers (including any third-party content, advertising, and analytics providers) may use a variety of technologies that automatically or passively collect certain information about your use of the Site whenever you visit or interact with the Site (“Usage Information”). Usage Information may include the browser, device model, and operating system you are using, IP address, the URL or advertisement that referred you to our Site, the search terms you entered into a search engine that led you to our Site, all of the areas within our Site that you visit, and the time of day you visit the Site, among other information. Usage Information also includes the IP address, mobile device identifier and carrier, or other unique identifier (“Device Identifier”) for any computer, mobile phone, or other device used to access the Site. A Device Identifier is a number that is automatically assigned to your device and our servers identify your device by its Device Identifier.

We may use Usage Information for a variety of purposes, including enhancing or otherwise improving the Site and our services, and to target content or offers to users. The Usage Information we collect is generally non-identifying, but if we associate it with you as a specific and identifiable person, we will treat it as Personal Information.

3.3. Location Data

“Location Data” is a category of Personal Information collected about the location of a mobile device or computer, including GPS location, for purposes of enhancing or facilitating our services, such as enabling enhanced functionality in our mobile application. We may also use information about the location of the device you are using to help us understand how our mobile application is being used. If you want to opt out of the collection of this location information, you may turn off the location services on your mobile device. The Location Data we collect is generally nonidentifying, but if we associate it with you as a specific and identifiable person, we will treat it as Personal Information.

3.4. Cookies and Local Storage

“Cookies” and local storage are pieces of information (data files) transferred automatically to an individual’s browser on their device when the device is used to visit a website. These technologies are able to store a unique identifier for a device to allow a certain Internet site to recognize the device whenever the device is used to visit the site, and may be used for many purposes, including remembering information that will make your use of the site more convenient. Like most Internet sites, the PAMM Website uses these technologies for a variety of purposes. For example, we use these technologies to serve targeted advertising elsewhere online, to track the total number of visitors to our site on an anonymous, aggregate basis, and to remember you when you return to the Site and remember your preferences. A Flash cookie is a data file placed on a device via the Adobe Flash plug-in that may be built into or downloaded by you onto your device. Flash cookies may be used for various purposes, including, without limitation, enabling a Flash feature and remembering your preferences. Like many websites, the PAMM Website utilizes third-party services to collect web traffic data and cookie data. See Section 7: THIRD-PARTY ANALYTICS PROVIDERS, AD SERVERS, AND SIMILAR THIRD PARTIES For more information.

Use the options in your Internet browser if you do not wish to receive a cookie or if you wish to set your browser to notify you when you receive a cookie. If you disable all cookies or adjust your Flash privacy settings on your device, you may not be able to take advantage of all the features of the PAMM website.

3.5. Web Beacons

Small graphic images or other web programming code called web beacons (also known as “pixel tags,” “1x1 GIFs,” or “clear GIFs”) may be included in our web pages and email messages. Web beacons may be invisible to you, but any electronic image or other web programming code inserted into a web page or email can act as a web beacon. Web beacons or similar technologies may be used for a number of purposes, including, without limitation, to count visitors to the Site, to monitor how users navigate the Site, to count how many emails that were sent were actually opened or to count how many particular links were actually viewed.

In addition, we may use a variety of other technologies that collect similar information for security and fraud detection purposes.

3.6. Information Third Parties Provide About You

We may receive information about you from third parties and we may supplement the information we collect with outside records in order to provide you with information, activities or services you have requested, to tailor content, to offer you opportunities to become involved in activities that we believe may interest you, and for other purposes. We may combine the information we receive from those other sources with information we collect through the Site. In those cases, we will apply this Privacy Policy to the combined information.

4. Children

PAMM does not knowingly collect personal identifying information from children under the age of thirteen (13). No information we collect from children known to be under the age of 13 is used for any marketing or promotional purposes. Such information is used solely to provide services. We will give out personal information about children if required by law, for example, to comply with a court order or subpoena or to protect the safety and security of visitors and our premises.

5. How Does PAMM Use My Information?

We may use the information we collect, including Personal Information, Usage Information and Location Data for the following.

5.1. Personalized Services

PAMM collects Personal Information in order to fulfill your online donations, orders and purchases, to acknowledge your purchases and donations, to offer you customer services and to inform you of products, promotions and other communications. We also use Personal Information to analyze and collect trends and statistical information. We may combine information from other sources with your Personal Information, visit data and transaction data.

5.2. Security and Payment Processing

We employ technologies designed to help secure the Personal Information we collect and store. Donor information is stored within a secure donor management database at PAMM. Access to the database is restricted to personnel with a legitimate business need to access or modify the information contained therein. However, no system can be guaranteed 100% secure. We therefore cannot ensure or warrant the security of any information that you transmit to us, or that we transmit to you, or guarantee that it will be free from unauthorized access by third parties.

PAMM uses Blackbaud products for payment processing and data storage. For further information on this subject please visit Blackbaud’s PCI Compliance page, your information is subject to Blackbaud’s privacy policy. Since we use a vendor to process credit-card payments made through the Site and to store associated payment data, PAMM does not directly collect such credit-card information, nor does PAMM store or have access to credit-card information submitted online. For donations made offline, PAMM may directly collect, store, or have access to credit-card information for processing payments.

6. With Whom Does PAMM Share My Information?

We may share non-Personal Information, such as Usage Information and aggregated user statistics, with third parties. PAMM does not sell or share Personal Information with unaffiliated third parties for their direct marketing purposes. We may share the information we have collected about you (including Personal Information): (i) as disclosed at the time you provide your information, (ii) with your consent, (iii) as described elsewhere in this Privacy Policy, or (iv) in the following circumstances:

6.1. Third Parties Providing Services on Our Behalf

PAMM may engage third-party companies to perform a variety of functions, such as assisting with donation collection, providing technical services for our Internet sites, etc. Such companies may have access to Personal Information if needed to perform certain functions on behalf of PAMM. However, these companies may use such Personal Information only for the purpose of performing that function and may not use it for any other purpose.

6.2. Administrative and Legal Reasons

PAMM reserves the right to use or disclose any information (including Personal Information) as needed to satisfy any law, regulation, or valid legal request, to protect the confidentiality, availability and integrity of the Website, systems or databases, to fulfill your requests, or to cooperate in any law-enforcement investigation or an investigation on a public safety matter, to protect and defend the legal rights or property of PAMM, our Site or its users, or any other party, or in an emergency, to protect the health and safety of our users or the general public.

We may disclose your Personal Information as necessary to resolve disputes, inquiries or complaints. We may disclose your Personal Information if we believe you have violated our Terms.

We reserve the right to disclose Personal Information that we believe, in good faith, is appropriate or necessary to: (a) take precautions against liability, (b) protect us or others from fraudulent, abusive, or unlawful uses or activity, © investigate and defend us against any third-party claims or allegations, (d) protect the security or integrity of the Website and any facilities or equipment used to make the Website available, or € protect our property or other legal rights, or the rights, property, or safety of others.

6.3. Surveys, Sweepstakes, Contests, & Promotions

We may ask for surveys, offer sweepstakes, contests, and other promotions (any, a “Promotion”) that may require registration. By participating in a Promotion, you are agreeing to the provisions, conditions, or official rules that govern that Promotion, which may contain specific requirements of you (including, except where prohibited by law, allowing the sponsor(s) of the Promotion to use your Personal Information, such as name, voice, likeness, or other indicia of persona in advertising or marketing materials. If you choose to enter a Promotion, your Personal Information may be disclosed to third parties or the public in connection with the administration of such Promotion, including, without limitation, in connection with winner selection, prize fulfillment, and as required by law or permitted by the promotion’s terms or official rules (such as on a winners list).

6.4. Social Networking Features

Functionality on the Website may permit interactions that you initiate between the Website and a third-party website or service such as Twitter (a/k/a “X”) or Facebook (“Social Networking Features”). Examples of Social Networking Features include enabling you to “like,” “comment” or “share” content from the Site or to “like,” “comment” or “share” our page on a third-party service; to automatically or selectively show your social media posts/tweets show your social media posts/tweets automatically or selectively on the Website; to create a PAMM account or PAMM personal profile using existing login information from a social network (known as a social login); and to otherwise connect the Website to a third-party website or service. If you choose to share content or to otherwise post information through the Website to a third-party site or service, or vice versa, that information may be publicly displayed. Similarly, if you post information on a third-party platform that references PAMM (for example, by using a Twitter (a/k/a “X”) hashtag associated with PAMM in your Tweet), your post may be published on the Website in accordance with the terms of that third party. Also, both PAMM and the third party may have access to certain information about you and your use of the Website and the third-party site or service. In addition, we may receive information about you if other users of a third-party website give us access to their profiles and you are one of their “connections” or information about you is otherwise accessible through your “connections” web page, profile page, or similar page on a social networking or other third-party website or service. If you choose to use a social login, we may collect Personal Information including your name and email address. The information we collect in connection with Social Networking Features is subject to this Privacy Policy. The information collected and stored by the third party remains subject to the third party’s privacy practices, including whether the third party continues to share information with us, the types of information shared, and your choices with regard to what is visible to others on that third-party website or service.

6.5. Business Transfers & Transitions

In the event PAMM goes through a transition (such as a merger, acquisition, joint venture, assignment, bankruptcy, sale, or divestiture of all or a portion of its assets, including, without limitation, during the course of any due diligence process) (“Change”), your Personal Information will likely be among the assets transferred as part of the Change. By providing your Personal Information, you agree that we may transfer such information to the acquiring entity without your further consent or right to Opt-Out.

7. Third-Party Analytics Providers, AD Servers, and Similar Third Parties

PAMM may engage reputable third parties, such as network advertisers, ad agencies, analytics service providers, and other vendors to provide us with information regarding traffic on the Website (including pages viewed and the actions taken when visiting the Site), to serve our advertisements elsewhere online, and to provide us with information regarding the use of the Site and the effectiveness of our advertisements. We may share non-Personal Information (including hashed or otherwise de-identified personal information) with service providers for these same purposes. In addition, our service providers may collect certain information about your visits to and activity on the Site and other websites and services and may use this information to target our and third-party advertising to you.

These service providers may set and access their own tracking technologies on your device and may otherwise collect or have access to information about you. Some of these parties may collect Personal Information over time as you visit online the Website, other websites and services. Cookies, including those set by third-party network advertisers, may be used to (among other things): target advertisements, prevent you from seeing the same advertisements too many times, and conduct research regarding the usefulness of certain advertisements to you. We may share Usage Information about visitors with third-party advertising companies, analytics providers, and other vendors for similar purposes.

For example, we use Google services, such as Google Analytics, to collect data about traffic across our

Site, to deliver advertisements when you visit other websites, and to share data about traffic to our website with Google and other Google Analytics program participants. Some of these companies are members of the Network Advertising Initiative (“NAI”) or the Digital Advertising Alliance (“DAA”) Self-Regulatory Program for Online Behavioral Advertising. Please note that these third-party advertising companies may still collect information from you and opting out through these mechanisms does not opt you out of being served advertising. You will continue to be served generic ads while online or on your device. The information you provide when using these tools is subject to the third parties’ Privacy Policies.

8. How We Respond to “Do Not Track” Signals

Some Internet browsers may be configured to send “Do Not Track” signals to the online services that you visit. There is no consensus among industry participants as to what “Do Not Track” means in this context. Like many websites and online services, the Site does not alter its practices when it receives a “Do Not Track” signal from a visitor’s browser. 9. Your Responsibilities

You are responsible for securing and maintaining the privacy of your login information and password(s) and verifying that your Personal Information is accurate and current. We are not responsible for the privacy or security of any information on the Site that you or others make publicly available or what others do with information you share with them. Be aware that certain Personal Information and other information in connection with your use of the Site may be stored on your device (even if we do not collect that information). You are solely responsible for maintaining the security of your device from unauthorized access.

9.1. Your Choices and Rights

You have choices when it comes to the privacy practices and communications described in this Privacy Policy. Many of your choices may be explained at the time you sign up for or use our Site or in the context of your use of our Site. You may be provided with instructions and prompts within the experiences as you navigate the Site. If you do not want your Personal Information used or shared as provided in this Privacy Policy, you should not use the Site. You may, of course, decline to share certain Personal Information with us in which case, we may not be able to provide some of the features and functionality of the Site.

9.2. Targeted Advertising

When you use our Site, we may collect information about your activities with your consent, so that we can provide you with advertising tailored to your interests. We may also use automated technologies to collect information when you interact with our Site through one of our partners, such as advertising and commerce features. For example, we may use information collected on other websites to show you more relevant ads.

Because we utilize advertising networks, you may see certain ads on other websites. Ad networks track your online activities over time by collecting information through use of cookies, web beacons, and other technologies. We use ad networks that combine information collected through our App with information collected from third-party sites that also take part in the relevant ad network. This information includes, for instance, the pages or advertisements you view and how you use the websites. This information helps us deliver advertisements that are targeted towards you based on your interests, other information related to you, and contextual means. Ad networks may also use this information to help their other customers deliver advertisements that are targeted towards you on those third-party sites. We request your separate consent before we use or disclose your information for targeted advertising purposes.

The companies we work with to provide you with targeted ads are required to give you the choice to opt out of receiving targeted ads. Most of these companies are participants of the Digital Advertising Alliance (“DAA”) and/or the Network Advertising Initiative (“NAI”). We are not responsible for the effectiveness of, or compliance with, any opt out options or programs, or the accuracy of any third-party statements regarding their opt-out options or programs.

Depending on the type and version of the operating system of your mobile device, you may also be asked whether to enable targeted advertising. You may also limit our use of information collected from or about your mobile device for purposes of serving targeted ads to you by going to your device settings and selecting “Limit Ad Tracking” (for iOS devices) or “Opt out of Interest-Based Ads” (for Android devices).

9.3. Marketing Communications and Commercial Email Opt-Out

When you create an account with us, unless you opt-out, we will use your email address to deliver digital communications from us or our advertisers or sponsors. When you communicate with us through any means such as chat or email, we may use your contact details for marketing communications. You can unsubscribe from email and other digital communications by following the instructions in the communication or by sending a request to us using the contact information listed below or through the Contact Us link provided at the bottom of every page of the Site.

If you opt-out of receiving commercial emails from us or otherwise modify the nature or frequency of promotional communications you receive from us, it may take up to ten business days for us to process your request, and you may receive promotional communications from us that you have opted-out from during that period. Additionally, even after you opt-out from receiving commercial messages from us, you will continue to receive administrative messages from us regarding the Site.

10. Your Choices and Rights / Unsubscribe / Opt-Out

When you request the deletion of your information, object or withdraw your consent to the processing of your information, we may not be able to provide all the features of the Site to you. You should be aware that it is not technologically possible to remove each and every record of the information you have provided to the Site from our servers.

To exercise any of these rights please contact us using the contact information listed. We will promptly review all such requests in accordance with applicable laws.

11. How Your Information is Secured

We follow generally accepted industry standards, including the use of appropriate administrative, physical, and technical safeguards, to protect the Personal Information collected by us. For example, when you enter Personal Information, we encrypt the transmission of that information or use secure connections.

Despite efforts to protect your Personal Information, no method of electronic transmission or storage is 100% secure, and there is always some risk that an unauthorized third party may find a way around our security systems or that transmissions of your information over the internet may be intercepted.

As required by applicable law, if we learn of a breach or unauthorized use or disclosure of your Personal Information, then we may attempt to notify you so that you can take appropriate protective steps. We may post a notice through the Site if a breach occurs. Depending on where you live, you may have a legal right to receive notice of a breach in writing, and we will follow all applicable laws.

12. How Long We Keep Your Personal Information

We may offer links to sites that are not owned, operated by, or affiliated with PAMM. If you visit one of these linked sites, you should review their privacy and other policies. We are not responsible for the policies and practices of others.

14. Users Residing Outside of the United States and Consent to Transfer

The Site is operated in the United States. If you are located in another jurisdiction, please be aware that information you provide to us will be transferred to and processed in the United States. By using the Site or providing us with any information, you consent to this transfer, processing, and storage of your information in the United States, a jurisdiction in which the privacy laws may not be as comprehensive as those in the country where you reside or are a citizen.

If we process or use your Personal Information, we shall endeavor to ensure, by implementing suitable measures, that your Personal Information is accurate and up to date for the purposes for which it was collected. If your Personal Information is inaccurate or incomplete, you may obtain the rectification of such Personal Information. You may obtain the erasure or restriction of processing of your Personal Information in situations where no legitimate business purpose exists, or the further storage is unnecessary.
  2. Right to data portability: You may receive the Personal Information that you have provided to us, in a structured, commonly-used, and machine-readable format or transmit this information to another controller.
  3. Right to object: You may object, on grounds relating to your particular situation, to the processing of your Personal Information. To the extent your Personal Information is processed for reasons other than direct marketing, you understand and agree that we have compelling legitimate reasons for information processing, such as providing access to our Site. You may use ad-blocking software to limit information capture and usage. Making a request does not guarantee that the request will be honored.

The Site is operated in the United States. If you are located in another jurisdiction, please be aware that information you provide to us will be transferred to and processed in the United States. By using the Site or providing us with any information, you consent to this transfer, processing, and storage of your information in the United States, a jurisdiction in which the privacy laws may not be as comprehensive as those in the country where you reside or are a citizen.

Rather, this Privacy Policy merely reflects guidelines setting forth PAMM’s intended business practices. From time to time and without prior notice, PAMM may change this Privacy Policy and will notify you of material changes by posting the changed or modified Privacy Policy on our Site. We may also provide notice to you in other ways in our discretion, such as through contact information you have provided. Any changes will be effective immediately upon the posting of the revised Privacy Policy unless otherwise specified and your continued use of the Site after the effective date of the revised Privacy Policy (or such other act as specified in the revised Privacy Policy) will constitute your consent to those changes. Rest assured, however, that unless we obtain your consent, any changes will not alter how we handle previously collected information.

We describe the Personal Information we have collected from consumers in the twelve (12) months preceding the effective date of this Privacy Policy in the section above titled, “What Type of Information Does PAMM Collected.”
